Intent
An action does not have to be intentionally upsetting or harmful to be harassment.
Something intended as “banter” could end up causing distress.
When deciding if something is harassment, the focus is on the perception of the person the behaviour is directed towards and the impact the behaviour has on them.
An example would be making fun of someone for having a mental health condition or physical disability, and them finding this hurtful.
